Scott R. Jamison is a member of Funk & Bolton, P.A., in the firm's Baltimore office. His practice focuses principally on representing employee health and welfare benefit plans and their insurers, with a particular emphasis on counseling nationwide Federal Employees Health Benefits (FEHB) plans. During his career Mr. Jamison has also represented a variety of ERISA-governed benefit plans including single-employer plans, jointly-trusted Taft-Hartley plans, and voluntary employee beneficiary associations. He has represented both types of plans in litigation conducted before state and federal courts, at both the trial and appellate levels.
As a result of representing FEHB plan clients in negotiating and performing the federal government contracts under which they are created, Mr. Jamison also possesses extensive knowledge of, and considerable experience in safely navigating clients through, the complexities of government contract law. He routinely advises clients on compliance issues arising under the Federal Acquisition Regulation, including but not limited to government contract cost allowability, cost accounting, and procurement questions. He has also assisted multiple government contract clients in obtaining satisfactory outcomes in federal Office of Inspector General audits.
Furthermore, while representing federally-governed health plan clients that operate nationwide Mr. Jamison has acquired considerable experience in questions relating to federal preemption of the state laws applicable to health insurance subrogation, and has successfully litigated these issues at both the state and federal appellate level. He also counsels clients on compliance with a wide range of employee benefits laws such as COBRA, HIPAA, USERRA, and the FMLA.
Mr. Jamison is a member of the American Bar Association, Maryland State Bar Association, the District of Columbia Bar Association, and the National Association of Subrogation Professionals.
