Supreme Court Brief of Amicus Curiae Aetna Inc. in Support of Petitioner
January 2010
Funk & Bolton attorneys recently filed an amicus curiae brief in the Supreme Court of the United States. The brief focuses on whether an action seeking coverage and benefits under a plan covered by the Federal Employees Health Benefits Act (FEHBA) is subject to complete preemption and removable to federal court. The Seventh Circuit determined complete preemption was inapplicable and directed remand to state court. Oral argument is scheduled for March 2010. The collaborative briefing effort was led by Counsel of Record, Bryan D. Bolton, with strong support from Michael P. Cunningham and Scott R. Jamison. A copy of the brief may be found in the firm's brief bank.
